Board of Directors self-certification - General Condition 6(3) and Continuity of Services Condition 7 NHS Provider Licence Compliance
The Board of Directors is required by its regulator NHS England to self-certify whether or not it has complied with the General Condition 6 and Continuity of Services condition 7 of the NHS provider licence. The Board of Directors considered that:
- In the financial year most recently ended, the licensee was satisfied that all such precautions had been taken as were necessary in order to comply with the conditions of the licence, any requirements imposed on it under the NHS Acts and with regard to the NHS Constitution (General Condition 6).
- After making enquiries the directors of the licensee have a reasonable expectation that the licensee will have the required resources available to it after taking account distributions which might reasonably be expected to be declared or paid for the period of 12 months referred to in this certificate (Continuity of Services Condition 7).
In previous financial years, as part of the regulatory oversight of NHS provider organisations, foundation trusts were required to submit an annual self-certificated confirming compliance with various NHS provider licence conditions. While this requirement no longer applies to all conditions within the provider licence, the Trust is still required to self-certify compliance with Condition CoS7: Availability of resources with a submission to the region.
Board of Directos self-certification – FT4 Corporate Governance Statement NHS Provider Licence Compliance
The Board of Directors is required by its regulator NHS Improvement to self-certify whether or not it has complied with the General Condition FT4 of the NHS provider licence. Following a review of the evidence and taking into account the views of the Council of Governors, the Board of Directors considered that that the Licensee had the necessary arrangements in place in order to currently fully comply with the conditions of the licence with regards to its corporate governance arrangements and good governance.
Board of Directors self-certification – Training for Governors NHS Provider Licence Compliance
The Board of Directors is required by its regulator NHS Improvement to self-certify whether or not it is satisfied that during the financial year most recently ended, the Trust has provided the necessary training to its Governors as required in section 151 (5) of the Health and Social Care Act, to ensure they are equipped with the skills and knowledge they need to undertake their role. Following a review of the evidence, and taking into account the views of the Council of Governors, the Board of Directors are satisfied that the necessary training was made available to Governors.
